class=\"wp-block-paragraph\">La <strong>nouvelle directive CNSS publi\u00e9e en mai 2025<\/strong> marque un tournant dans la r\u00e9glementation des cotisations sociales au Maroc.<br>Ce texte fixe d\u00e9sormais une liste exhaustive des <strong>indemnit\u00e9s exon\u00e9r\u00e9es<\/strong>, leurs <strong>plafonds<\/strong>, et les <strong>conditions de justification<\/strong>.<br>Mais malgr\u00e9 cet effort d\u2019harmonisation, plusieurs <strong>\u00e9carts subsistent avec la circulaire DGI de 2017<\/strong>, encore en vigueur pour le calcul de l\u2019<strong>imp\u00f4t sur le revenu (IR)<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cet article analyse les <strong>principales nouveaut\u00e9s<\/strong> de la directive CNSS 2025 et les <strong>divergences<\/strong> persistantes avec la r\u00e9glementation fiscale.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Une r\u00e9forme sociale centr\u00e9e sur l\u2019\u00e9quit\u00e9 et la clart\u00e9<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">La nouvelle directive CNSS introduit une classification compl\u00e8te des indemnit\u00e9s exon\u00e9r\u00e9es, leurs plafonds et les justificatifs exig\u00e9s.<br>Elle \u00e9tablit un lien direct entre le SMIG et les montants exon\u00e9r\u00e9s, permettant une adaptation automatique aux \u00e9volutions \u00e9conomiques.<br>Ainsi, la prime de panier, l\u2019indemnit\u00e9 de salissure, ou encore la prime d\u2019outillage sont d\u00e9sormais fix\u00e9es en multiples du SMIG horaire (17,10 Dhs).<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Une extension du champ des exon\u00e9rations<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">La CNSS 2025 \u00e9largit consid\u00e9rablement la liste des indemnit\u00e9s non soumises \u00e0 cotisations :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"\">Gratifications sociales familiales (mariage, naissance, d\u00e9c\u00e8s, Achoura, rentr\u00e9e scolaire\u2026) jusqu\u2019\u00e0 5 000 Dhs\/an ;<\/li>\n\n\n\n<li class=\"\">Aides au logement et pr\u00eats sociaux exon\u00e9r\u00e9s d\u2019int\u00e9r\u00eats ;<\/li>\n\n\n\n<li class=\"\">Indemnit\u00e9s exceptionnelles li\u00e9es \u00e0 l\u2019\u00e9tat d\u2019urgence sanitaire ;<\/li>\n\n\n\n<li class=\"\">Aides collectives et \u0153uvres sociales exon\u00e9r\u00e9es \u00e0 hauteur de 3 % de la masse salariale ;<\/li>\n\n\n\n<li class=\"\">Indemnit\u00e9s de formation, apprentissage, insertion ANAPEC, etc.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Ces dispositions traduisent une volont\u00e9 d\u2019encourager la coh\u00e9sion sociale et la formation professionnelle au sein des entreprises.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Des conditions de justification renforc\u00e9es<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Chaque indemnit\u00e9 doit d\u00e9sormais \u00eatre appuy\u00e9e par des pi\u00e8ces probantes : ordres de mission, factures, fiches de d\u00e9placement ou attestations.<br>La CNSS insiste sur la tra\u00e7abilit\u00e9, afin d\u2019\u00e9viter toute assimilation abusive \u00e0 des compl\u00e9ments de salaire.<br>Cette rigueur documentaire distingue nettement la CNSS de la DGI, qui reste plus souple dans ses exigences.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Les divergences majeures avec la DGI<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Malgr\u00e9 cette mise \u00e0 jour, la circulaire DGI de 2017 n\u2019a pas encore \u00e9t\u00e9 r\u00e9vis\u00e9e.<br>Ainsi, des diff\u00e9rences importantes persistent :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"\"><strong>Plafonds diff\u00e9rents<\/strong> : la CNSS fixe d\u00e9sormais 5 000 Dhs pour certaines indemnit\u00e9s, contre 2 500 Dhs \u00e0 la DGI.<\/li>\n\n\n\n<li class=\"\"><strong>Exon\u00e9rations non pr\u00e9vues fiscalement<\/strong> : \u0153uvres sociales, cantines, repas Ramadan, indemnit\u00e9s d\u2019urgence, etc.<\/li>\n\n\n\n<li class=\"\"><strong>Traitement des stages ANAPEC<\/strong> : dur\u00e9e et plafonds divergents.<\/li>\n\n\n\n<li class=\"\"><strong>Justifications<\/strong> : la CNSS exige une documentation plus compl\u00e8te, alors que la DGI se limite souvent au respect des plafonds.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Ces \u00e9carts peuvent entra\u00eener des divergences entre <strong>assiette CNSS<\/strong> et <strong>assiette IR<\/strong>, n\u00e9cessitant une vigilance accrue des employeurs et experts-comptables.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Vers une n\u00e9cessaire harmonisation CNSS\u2013DGI<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">La publication de la directive CNSS 2025 devrait logiquement conduire la DGI \u00e0 <strong>mettre \u00e0 jour sa circulaire<\/strong> afin d\u2019\u00e9viter les doubles r\u00e9gimes.<br>Cette harmonisation est cruciale pour :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"\">simplifier la gestion de la paie,<\/li>\n\n\n\n<li class=\"\">r\u00e9duire les risques de redressement,<\/li>\n\n\n\n<li class=\"\">et instaurer une coh\u00e9rence entre les politiques sociales et fiscales.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">R\u00e9capitulatif des divergences CNSS VS DGI : class=\"wp-block-heading\"><strong>Conclusion<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">La directive CNSS 2025 constitue une avanc\u00e9e majeure vers une meilleure transparence sociale.<br>Elle valorise les politiques internes de bien-\u00eatre et de formation, tout en imposant une rigueur accrue dans la justification des avantages.<br>En revanche, tant que la DGI n\u2019aura pas actualis\u00e9 sa note de 2017, les entreprises devront composer avec <strong>deux r\u00e9f\u00e9rentiels distincts<\/strong> : un social, un fiscal.<\/p>\n\n\n\n<p
